Lawsuit Regarding Overcharged Fees at Birmingham Schools Heads Back to Court

Timothy Mullins, attorney for Birmingham Public Schools, says the lawsuit filed in November by two Derby Middle School parents lacks merit.

A lawsuit currently facing Birmingham Public Schools over overcharged student fees returns to the courtroom on Wednesday. The school district is currently being sued by Troy residents and parents of a Derby Middle School 6th grader, John and Laurie Kelly, both of whom allege the district is breaking state law by requiring parents to pay for various required workbooks, textbooks, locks and gym uniforms. And on Wednesday, the Kellys and their attorney, Mark Wasvary, will appear before Oakland County Circuit Court Judge Michael Warren for a hearing to determine whether the trio will have more time to give the lawsuit a class action certification. Just a little update...from what I read on the Oakland County website, the motion for more time to turn this into a class action has been granted. ARE YOU KIDDING ME??? I wonder what happened today to convince the judge that these people (and I use that word politely) needed more time. They have had 2 months to get more people in on this ridiculous suit. Derby Parents Sue Birmingham Schools Over Overcharged Fees

Parents were asked to pay for student planners, locks and gym uniforms this year. According to the lawsuit, however, that violates the Michigan Constitution.

Should Birmingham Public Schools be asking its middle school parents to pay for required gym uniforms? How about student planners and locks? Those kinds of questions, and more, are at the center of a class action lawsuit filed by two Birmingham parents against the school district, alleging the district overcharged them — and many more parents — during this year's annual registration period. Specifically, the lawsuit — filed in Oakland County Circuit Court on Nov. 2 — alleges that Birmingham Public Schools was breaking state law at both middle schools by requiring parents to pay for various required workbooks and textbooks, locks and gym uniforms. Birmingham schools were official made aware of the additional illegal mandatory fees over two years ago. Some schools [Seaholm for example] fixed the problem by making fees voluntary. Derby administration refused to make changes and would not issue refunds. Derby School administration caused this lawsuit by ignoring the wishes of parents and the Law.   more ›

Rifle-Toting Teen Sues City of Birmingham for Violating His Civil Rights

Sean Combs, 18, was arrested for carrying a rifle in downtown Birmingham in April; he was found not guilty of disturbing the peace and brandishing a firearm in July.

UPDATED 5:20 p.m.: Sean Combs, the 18-year-old Troy resident who was arrested in April for openly carrying his loaded rifle through downtown Birmingham, filed a lawsuit Friday at Michigan Eastern District Court in Detroit alleging the City of Birmingham and three officers from the Birmingham Police Department violated his civil rights when they arrested him in April. Combs was found not guilty of brandishing a firearm and disturbing the peace by a seven-member jury on July 12 at 48th District Court in Bloomfield Township. A third charge of obstructing an officer was dismissed during trial due to lack of evidence. "I tried being nice," said Combs, a recent Troy High School graduate who currently attends Oakland Community College. "They …
